These Terms of Service (the "Terms") govern the conditions of use for Plachieve (the "App").

By using the App, users (each a "User") agree to these Terms.

1. Introduction

The App is designed to help Users manage schedules, goals, and progress, receive notifications, display home screen widgets, and manage the Pro plan.

The App is intended to assist Users in creating schedules, setting goals, and organizing their study and work plans.

However, the App does not guarantee any specific outcome, including achievement of schedules or goals, improved grades, increased income, or improved quality of life.

2. App Features

The App provides the following main features:

  • Management of schedules, task blocks, and fixed events
  • Management of goals, checkpoints, and progress
  • Management of daily templates and block templates
  • Storage of completion records
  • Local notification reminders
  • Display of schedules on home screen widgets
  • UI settings including themes and colors
  • Creation and restoration of backup files
  • Access to certain features or ad removal via the Pro plan
  • Display of advertisements in the Free plan

The features of the App may be added, changed, or removed in future updates.

3. Conditions of Use

Users shall use the App in compliance with these Terms and all applicable laws and regulations.

Minors must obtain consent from a parent or legal guardian before using the App, as required.

Users are responsible for preparing, at their own expense, all devices, operating systems, network environments, Apple IDs, and App Store access required to use the App.

4. Account Registration

The App is a locally stored app that generally does not require account registration.

Data entered by Users in the App, such as schedules, goals, profile settings, templates, and UI settings, is stored on the User's device.

The developer does not collect schedules, goals, profile settings, templates, UI settings, or other content entered by Users in the App.

However, for the purpose of displaying advertisements and processing payments, Google AdMob and Apple App Store / StoreKit may process information necessary to provide their respective services.

5. Data Stored on Device

The App may store the following information on the User's device:

  • Schedules, task blocks, fixed events, and completion records
  • Goal titles, checkpoints, progress, and achievement notes
  • Estimated sleep, meal, and break times, and lifestyle type
  • Daily templates and block templates
  • Themes, color settings, and display settings
  • Active or inactive status of the Pro plan

This information is stored solely on the User's device and is not transmitted to the developer's servers.

However, data stored on the device may be lost if the User loses their device, deletes the App, encounters OS issues, device failure, a device change, or for any other reason.

Users are responsible for creating and managing backups at their own discretion.

6. Backup

The App may allow Users to manually create backup files.

Backup files may contain in-app data such as schedules, goals, templates, and settings.

Users are solely responsible for managing the storage location, sharing, and handling of backup files.

The App may offer password-based encryption for backup files using AES-256-GCM.

If a User shares a backup file with a third party, or if the storage location, device, or password are inadequately managed, a third party may be able to access the data.

To the extent permitted by law, the developer is not responsible for the storage, sharing, loss, deletion, forgotten passwords, or failed restoration of backup files by Users.

Backup files do not include the Pro plan purchase status. Pro plan restoration is handled based on Apple App Store / StoreKit purchase records.

7. Notifications

The App may send local notifications, such as reminders before the start of fixed events.

Notifications are processed on the User's device and are not transmitted to the developer or any external server.

The timing, availability, sound, and banner display of notifications may be affected by iOS settings, device status, Focus modes, notification permission settings, and OS behavior.

The App does not guarantee that notifications will always be delivered at the exact scheduled time or that they will always be displayed.

Users may change or disable notification settings through iOS Settings or within the App.

8. Home Screen Widgets

The App may display schedule information on home screen widgets.

Data required for widget display is shared between the App and the widget via the App Group area on the device.

This data is used only on the device and is not transmitted to the developer or any external server.

The content, update frequency, and timing of widget display may be affected by iOS behavior, device status, battery level, and background refresh restrictions.

The App does not guarantee that widget content will always update instantly or be displayed accurately at all times.

9. Free Plan and Advertisements

The Free plan of the App may display advertisements.

Third-party services such as Google AdMob may be used to deliver advertisements.

Google AdMob may collect and process advertising IDs, device information, and usage data for purposes such as ad delivery, measurement of ad effectiveness, fraud prevention, and ad optimization.

The content, frequency, format, and destination links of advertisements may be determined by third-party services such as Google AdMob.

The developer does not warrant the accuracy, safety, legality, or usefulness of any advertisement, linked product, service, or website.

If a User accesses a linked destination from an advertisement, the User does so subject to the terms, privacy policy, and other conditions of the provider of that destination.

Users on the Pro plan will not see advertisements within the App. However, advertisements may temporarily not be hidden correctly due to OS issues, connectivity issues, delays in reflecting purchase status, or app bugs.

10. Pro Plan and In-App Purchases

The App may allow Users to purchase the Pro plan through Apple App Store / StoreKit.

Purchasing the Pro plan may allow Users to remove ads and access other Pro features.

The content, pricing, and terms of the Pro plan are as displayed within the App or on the App Store.

Purchase processing, billing, refunds, purchase history, and payment method management are handled through Apple App Store and Apple ID.

The developer does not collect credit card numbers, bank account information, or any other payment information from Users.

Cancellations, refunds, and payment method changes after purchase are subject to Apple's terms and procedures.

The App manages the Pro plan active/inactive status on-device based on Apple's billing processing results.

Reflecting purchase status may take time depending on device status, Apple ID status, network conditions, App Store behavior, and OS issues.

Users may restore the Pro plan purchase status using the App's restore purchase feature, if available.

The features included in the Pro plan may change with future updates. However, the developer will endeavor to avoid changes that are unfairly disadvantageous to Users.

Some Pro plan features may be changed, suspended, or discontinued due to OS, App Store, StoreKit, or Apple specification changes, changes to external services, changes in laws, or maintenance requirements.

11. Prohibited Conduct

Users must not engage in any of the following when using the App:

  • Violating applicable laws or public order and morals
  • Engaging in criminal activity or conduct related to criminal activity
  • Misusing, tampering with, or reverse-engineering the App
  • Decompiling, disassembling, or otherwise reverse-engineering the App
  • Fraudulently altering the Pro plan purchase status
  • Manipulating ad display or ad delivery mechanisms
  • Interfering with the normal operation of the App
  • Causing damage, disadvantage, or discomfort to the developer, other Users, or third parties
  • Infringing on the intellectual property rights of the App
  • Using the App for unauthorized purposes
  • Any other conduct the developer deems inappropriate

12. Intellectual Property Rights

All copyrights, trademarks, and other intellectual property rights related to the App belong to the developer or to legitimate third-party rights holders.

Users may use the App on a personal, non-exclusive basis in accordance with these Terms.

Use of the App does not transfer any intellectual property rights in or to the App to Users.

Rights to schedules, goals, notes, templates, and other content entered by Users into the App remain with the Users themselves.

13. Changes, Suspension, and Termination of the App

The developer may, as necessary, change the content, specifications, features, design, pricing, or terms of the App.

The developer may suspend or terminate all or part of the App in any of the following cases:

  • When performing maintenance, inspection, correction, or updates to the App
  • When OS, App Store, StoreKit, Google AdMob, or other external services change their specifications
  • When provision becomes difficult due to device, OS, external service, or development environment issues
  • When required by laws, government agencies, or courts
  • In the event of disasters, accidents, communication failures, system failures, or other unavoidable circumstances
  • When the developer determines that continued provision of the App is no longer feasible

To the extent permitted by law, the developer is not responsible for any damage caused to Users by changes, suspension, or termination of the App.

14. Disclaimer

The App is provided "as is."

The developer does not warrant the App's accuracy, completeness, usefulness, fitness for a particular purpose, continuity, freedom from defects, or absence of security vulnerabilities.

The App is a tool to assist with schedule management, goal management, and progress tracking, and does not guarantee any specific result such as achieving schedules, achieving goals, improved grades, increased income, or improved quality of life.

Users are solely responsible for judgments made based on their use of the App.

Data may be lost due to device failure, loss, OS issues, App deletion, device replacement, insufficient storage, backup failure, or User error.

Except in cases of the developer's willful misconduct or gross negligence, and to the extent permitted by law, the developer is not responsible for any damage caused by loss, corruption, or unrecoverability of User data, delayed or undelivered notifications, delayed or inaccurate widget display, advertisements, or issues with external services.

15. Damages

If a User violates these Terms or causes damage to the developer or any third party through unauthorized use of the App, the User shall be liable to compensate for such damage.

Even if the developer is liable to a User for damages in connection with the App, except in cases of willful misconduct or gross negligence, the developer's liability shall be limited to direct and ordinary damages actually incurred by the User.

Even if the developer is liable to a User for damages in connection with paid features, except in cases of willful misconduct or gross negligence, the maximum amount of compensation shall be the total amount actually paid by the User for the App in the one year preceding the occurrence of the damage.

The foregoing limitations do not apply where prohibited by applicable law.

16. Privacy

The handling of User information in the App is governed by the separately established Privacy Policy.

In-app data such as schedules, goals, profile settings, templates, and UI settings entered by Users is stored on the User's device.

However, for the purpose of displaying advertisements and processing payments, Google AdMob and Apple App Store / StoreKit may process information necessary to provide their respective services.

17. Specified Commercial Transactions Act (Japan)

Where paid features are offered in the App, disclosure pursuant to Japan's Act on Specified Commercial Transactions will be provided separately as required.

For pricing, payment timing, delivery timing, cancellation/return, and contact information related to paid features, please refer to the in-app display, App Store listing, or the separately provided disclosure.

18. Changes to These Terms

The developer may update these Terms as necessary.

When making changes, the developer will post the updated Terms within the App or on a webpage managed by the developer.

Updated Terms take effect when posted within the App or on the webpage, or on the effective date specified at the time of posting.

If a User continues to use the App after changes to these Terms, the User is deemed to have agreed to the updated Terms.

19. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Japan.

Any dispute between the User and the developer arising in connection with the App or these Terms shall be subject to the exclusive jurisdiction of the Sapporo District Court or Sapporo Summary Court as the court of first instance.
